1. Acceptance
By accessing or using Analytics Capture, you agree to these Terms of Service. If you use the service for an organisation, you represent that you have authority to accept these terms on its behalf.
2. The service
Analytics Capture provides tools for website and implementation discovery, privacy-filtered measurement evidence, event mapping and governance, analysis, monitoring and controlled delivery to third-party destinations. Features may vary by plan, environment or release stage.
Analytics Capture can prepare, preview or deliver technical measurement instructions, but you remain responsible for reviewing production changes before publishing or enabling them.
3. Accounts and workspaces
You are responsible for maintaining the security of your account, keeping workspace configuration accurate and restricting access to authorised users. You must promptly notify us if you believe your account or credentials have been compromised.
4. Your websites and data
You retain responsibility for the websites, datasets, measurement plans and other content you provide or configure. You grant Analytics Capture the limited rights necessary to host, process and transmit that information to provide the service.
You must not intentionally submit passwords, payment-card data, medical records, highly sensitive free-text form content or other information that the product is not designed to collect. You are responsible for providing notices, obtaining consent and establishing any lawful basis required for tracking, analytics or destination delivery on your websites.
5. Acceptable use
You must not misuse the service, attempt unauthorised access, interfere with service operation, evade technical limits, introduce malicious code, use the service to violate law or third-party rights, or use public scanning features against systems you are not entitled to assess.
6. Third-party integrations
Analytics Capture can connect to third-party services such as Google Analytics, Google Tag Manager, analytics platforms, advertising systems, warehouses and APIs. Your use of those services remains subject to their own terms, permissions and policies.
For Google Analytics reporting, Analytics Capture requests read-only access only after you choose to connect Google. You can disconnect the integration from Analytics Capture or revoke access from your Google Account. Analytics Capture does not obtain ownership of your Google data.
7. Plans, trials and billing
Some features may require a paid plan, add-on, trial or beta entitlement. Prices, limits and billing intervals shown at purchase form part of these terms. Unless stated otherwise, recurring services continue until cancelled in accordance with the billing provider's available controls.
8. Intellectual property
Analytics Capture and its software, designs, documentation and branding are protected by intellectual-property laws. Except for the rights needed to use the service, these terms do not transfer ownership of Analytics Capture technology to you. You retain ownership of your own content and data.
9. Beta and changing features
Some functionality may be labelled beta, preview, experimental or planned. Such features may change, be limited or be withdrawn. We may update the service to improve security, reliability, functionality or compliance.
10. Availability and warranties
We aim to provide a reliable service, but Analytics Capture is provided on an “as available” basis to the extent permitted by law. We do not guarantee uninterrupted operation, that third-party APIs will remain available, or that every measurement recommendation will be suitable for your implementation.
You are responsible for validating measurement, consent and production configuration before relying on it for business, legal or regulatory decisions.
11. Liability
Nothing in these terms excludes liability that cannot lawfully be excluded. To the maximum extent permitted by law, Analytics Capture will not be liable for indirect, incidental, special or consequential losses, lost profits, lost revenue, lost data or losses caused by third-party platforms, customer configuration or unauthorised use of an account.
12. Suspension and termination
You may stop using the service at any time. We may suspend or terminate access where reasonably necessary for security, non-payment, serious misuse, legal compliance or a material breach of these terms. Where practical, we will provide notice before a non-urgent suspension.
13. Changes to these terms
We may update these terms as the service evolves. Material changes will be reflected by an updated effective date and, where appropriate, an in-product or account notice.
14. Governing law
These terms are governed by the laws of England and Wales, except where mandatory consumer law in your country provides otherwise. The courts of England and Wales will have jurisdiction subject to any mandatory rights you may have elsewhere.
15. Contact
Questions about these terms can be raised through the support or account contact channel available in Analytics Capture or on the Analytics Capture website.
